Fee Transparency

As part of our commitment to our clients we are transparent about what we charge.

 Uncontested Probate

Grant Extract Only Service:
Ideal for smaller estates where the Executors wish to carry out some of the work
  • Meeting with you at a single initial meeting to review estate.
  • Drafting of the Probate Oath/Statement
  • Completing the relevant HMRC forms
  • Completing the Application
  • Making the application to the Probate Registry on your behalf

We do not have any other involvement in the probate case leaving you free to handle all other the aspects of the estate administration.

  • Establishing the assets
  • Obtaining asset valuations or relevant documents to apply
  • Completing any tax returns or forms
  • Calculating/paying any taxes that may be due
  • Paying estate debts
  • Distributing the assets to beneficiaries
  • Transferring the legal title of any property

It normally takes between 8 – 16 weeks.
Full Estate Administration service:
Ideal for larger or complicated estates with multiple beneficiaries and  bank accounts,  real estate and shares and bond holdings
Handling all aspects of administering the estate including:

  • Gathering all the information and paperwork of the estate
  • Obtaining the original Will and ensuring that it is valid
  • Identifying Executors and beneficiaries
  • Notifying financial institutions and obtaining account balances
  • Preparing Probate Oath/Statement and applying to the Probate Registry
  • Liaising with the Probate Registry with any queries or
  • Establishing the assets
  • Completing and paying tax returns

Paying estate debts

  • Preparing Final estate Accounts
  • Distributing assets to beneficiaries
  • Transferring the legal title of any property
  • Disputed probates or dealing with disputes between beneficiaries
  • Deeds of Variation
Our fees are 3% of the gross value of the estate before tax and any other deductions.

This service is provided by a dedicated and experienced senior probate solicitor.

On average, estates of this complexity are dealt with within 6-12 months.

Purchase
( WITHOUT A MORTGAGE)
Time scale is dependent on a number of factors, many of which are beyond our control.  

The average process takes between 4 to 16weeks. It can be quicker or slower, depending on the parties in the chain and any unforeseen complications.

  • Take your instructions and give you initial advice
  • Liaise with estate agent and legal team of seller
  • Carry out searches
  • Give you advice on all documents and information received
  • Send final contract to you for signature
  • Agree completion date (date from which you purchase the property)
  • Exchange contracts and notify you that this has happened
  • Arrange for all monies needed to be received
  • Complete purchase
  • Deal with payment of Stamp Duty
  • Deal with application for registration at Land Registry
Search Fees:

We carry out searches on your behalf to ensure that you have as much information about the property as possible before completing your purchase. We generally carry out these standard searches for any property purchase.

  • Local Authority Search  Varies from council to council and can range from £140.00 incl VAT to £250.00 incl VAT)

The search consists of information from the Local Authority regarding Planning Application, Building Regulation Consents, responsibility for the road, Enforcement Notices and other matters relating to the property

  • Water & Drainage Search (estimate £42.50 + VAT)

The search consists of information from the local water and sewerage suppliers regarding connections to the property, mains and surface water drainage and sewers within the boundaries of the property which may remain the responsibility of the water company.

  • Environmental Search (starting from £40.00 + VAT)

The searches consist of information regarding flood risk, ground stability and contaminated land. This is generally the same information as that used by insurers to determine insurance premiums.

The Search fees detailed above are subject to VAT.

Post completion:

  • Chancel Repair Liability Indemnity Policy (£20.00 + VAT)

A significant proportion of properties within the local area are potentially liable to contribute towards chancel repairs and we find that the most cost-effective way to deal with this on our clients’ behalf is to put in place an indemnity policy, to protect YOU.

  • HM Land Registry fee

On completion of any purchase, it is compulsory for the property to be registered with HM Land Registry. The Land Registry fee is based upon the price paid for the property and the type of application being made. You can calculate the amount of the Land Registry Fee using HM Land Registry’s fee calculator http://landregistry.data.gov.uk/fees-calculator.html

  • Stamp Duty or Land Tax

This depends on the purchase price of your property. You can calculate the amount you will need to pay by using HMRC’s website https://www.tax.service.gov.uk/calculate-stamp-duty-land-tax/#/intro or if the property is located in Wales by using the Welsh Revenues Authority’s website here https://beta.gov.wales/land-transaction-tax-calculator

£675.00 + VAT

  • In addition there may be a bank charge for the transfer of funds to your seller’s legal representatives
  • Unlike other solicitors, Wells Legal does not work with 3rdparties for referrals. Accordingly we do not pass on to our clients the costs of such referrals.
  • Other payments you may wish to provide for include those to your surveyor, removal help etc. Please liaise with them directly.
Sale Time scale is dependent on a number of factors, many of which are beyond our control.

  • Prepare contract documents
  • Receive and advise on contract documents
  • Request searches
  • Answer any purchaser enquiries
  • Complete sale
  • Send sale proceeds to you / your seller’s legal representative if there is an onward purchase
  • Pay commission to your estate agent if applicable
Search Fees:

We carry out searches on your behalf to ensure that you have as much information about the property as possible before completing your purchase. We generally carry out these standard searches for any property sale:

  • Title documents from Land Registry (between £3.00 to £6.00)
  • Bankruptcy Search: £2.00 per name
£595.00 + VAT

  • Additionally there may be a bank charge for the transfer of funds to yourselves or your seller’s legal team if there is an onward purchase.
  • If a mortgage needs to be redeemed there will be an additional charge of £150.00 + VAT
  • Unlike other solicitors, Wells Legal does not work with 3rd parties for referrals. Accordingly we do not pass on to our clients the costs of such referrals.
  • Other costs you may wish to provide for include an Energy Performance Certificate, commission of your estate agents, removal help,  etc.

*Disbursements: These are costs relating to your matter that are payable to third parties such as Land Registry fees.

We handle the payment of the disbursements on your behalf to ensure a smooth process.
